Court rejects bail application of Sarpanch in fake appointment case

JAMMU, Apr 8: Railway Magistrate Jammu R K Lalhal has rejected the bail application of one Abdul Qayoom Khan, who is presently Sarpanch of Mandi Poonch, in fake appointment case.
After perusal of the CD file, the court observed, “instant FIR got registered on 13.03.2023 on the behest of a Letter No. 01/SS/JAT/023 dated 13.03.2023. The main allegations as alleged in the complaint are that on 13.03.2023, a person namely Abdul Qayoom, Panchayat member from Sidhra entered the office of complainant along with three other persons and produced an appointment letter from the office of Divisional Railway Manager New Delhi which turned out to be fake”.
Upon this FIR No. 07/2023 for the offence/s punishable under Sections 420/467/468 IPC was registered. During the course of investigation, Investigating Officer seized the posting orders and recorded the statement of witnesses (victim) under Section 161 Cr PC.
The main allegations are that accused grabbed Rs 2.5 lakh from Sher Khan, Rs 1.5 lakh from Daud Khan, Rs 3 lakh from Suleman Khan, Rs 3,80,000 from Shahid Khan, Rs 3,50,000 from Tanveer Ahmed Khan and issued fake orders of appointment.
After hearing both the sides, Railway Magistrate observed, “keeping into consideration the nature of the offence, maximum punishment prescribed for the alleged offence, stage of investigation and law laid down, I am of the considered opinion that prima facie case is not made out in favour of accused”, adding “in case bail is granted, people will lose faith in the judicial system and it is against the larger interest of the society as well”.
