JAMMU, Apr 15: Principal Sessions Judge Udhampur Haq Nawaz Zargar today awarded death penalty to one Jeet Singh, son of Krishan of Rassain village of Ramnagar tehsil for killing his mother.
“The evidence has shown that the convict after injuring the defence-less mother with sickle, severed the head with an axe. Obviously, the mother, particularly, old age is no threat to any son even to the convict in this case also”, the court said, adding “the old mothers would always look for love and care from their kids at the fag end of their lives. The way convict had done away with his age old mother is the gravest case of breach of trust”.
“The instant crime has been committed for the reason that the convict was demanding two kanals of land from the deceased besides asking her to reside with the other son Mulakh Raj. Such kind of crimes besides being anti-social, shock the very conscious of the society where the relation of mothers are taken on highest pedestal on the moral as well as religious grounds”, the court said, adding “killing one’s own mother is the most sacrilegious act and it definitely hits the very existence of humanity where the mother’s are being recognized none less than God for having been blessed with the capacity to conceive and to give birth to the young ones, symbolizing the power of God of creating this universe and furthermore, plays pivotal role in shaping the future of her kids”.
Stating that cases of such nature arose intense and extreme indignation of the society, which ultimately gives ample power to the courts to award maximum punishment for commission of such acts by the wrong doers, the Principal Sessions Judge said, “the convict might be of the age of 45 years but has a criminal history behind him of having also been punished for two years and 06 months for the commission of offence under Sections 326/341 RPC respectively”.
“The manner in which the crime has been committed by the convict has definitely caused physical and mental impact not only on the wife of the convict but also on the kids of the convict who have witnessed the crime”, the court said, adding “furthermore, it is clear that the convict had made the preparation for the commission of crime in case when the deceased mother did not concede to his demands”.
“The conduct of the convict for murder of his own mother places the facts of the case in heinous kind of offences for awarding of maximum punishment”, the court said, adding “the convict had also attempted to kill his wife when she intervened and tried to save the deceased from the brutal attacks of the convict. Had the wife stayed there or the sickle had not dropped from the hand of the convict, he would have definitely killed his wife also”.
“This case falls within the ambit of rarest of rare cases and therefore, accused Jeet Singh does not deserve any leniency in the sentences to be awarded to him except sending the convict to gallows would be adequate”, the Judge said.
Accordingly, death penalty was awarded to the convict.
Case was investigated by Inspector Deepak Pathania, then SHO Ramnagar, who was Investigating Officer of the case. Evidences were very meticulously gathered by the IO.
