HC appoints Div Com as Nodal Officer on hassle free movement of ambulances

Srinagar, May 11: High Court has appointed Divisional Commissioner Kashmir as Nodal Officer and directed him to file his comprehensive affidavit on behalf of all the authorities with regard to Standard Operating Procedure for hassle free movement of patients care ambulances in Jammu and Kashmir.
Division Bench of Chief Justice N Kotiswar Singh and Justice Wasim Sadiq Nargal after hearing amicus to the PIL advocate Toyiba appointed Divisional Commissioner Kashmir as Nodal Officer in the case so that to file an comprehensive report on behalf of all the authorities with regard to availability of ambulances in the Hospitals and other health centers and SOP for hassle free movement of these ambulances while taking patients from one place to other.
“…It will be appropriate that a Nodal Officer be appointed, who will give a consistent view on behalf of the various agencies before this Court. Under the circumstances, we appoint the Divisional Commissioner, Kashmir to be the Nodal Officer, who may file the comprehensive affidavit on behalf of the respondents, based on the inputs received from the various departments, so that there is unanimity and consistency in the stand taken by the respondents. Accordingly, the Divisional Commissioner Kashmir will file the affidavit taking into consideration various averments, assurances, undertakings made by the respondents in this Public Interest Litigation”, DB directed.
Divisional Commissioner has to gather inputs on the issue from Commissioner Secretaries of Home, Health, Transport, Director Health Services Kashmir and Jammu, DGP, IGP, Transport Commissioner and Principal Govt Medical College and thereafter as per the court directions submit a comprehensive and complete details in shape of affidavit before the court on next date of hearing.
Also directions are sought for equipping all the hospitals, rural and urban, with modern high technology patient care ambulances with trained drivers. “Direct respondents to remove old and unequipped ambulances from the fleet being run and operated by the respondents unless the same are certified to be fit for usage by the competent authority”, PIL reads.
