Quashing of FIR in corruption case

JAMMU, May 15: Supreme Court today admitted Special Leave Petition (SLP) filed by Anti-Corruption Bureau (ACB), Jammu challenging the judgment rendered by the Jammu & Kashmir High Court.
The High Court of J&K had quashed the FIR in a corruption case against three officials of the Jammu Municipal Corporation namely Rajesh Gupta, Chief Enforcement Officer, Madan Lal, Assistant Enforcement Officer and Kuldeep Kumar, Enforcement Inspector.
The FIR registered by the ACB, alleged that the officials of Jammu Municipal Corporation had conspired with one Manju Gupta, in helping her raise illegal construction on a plot of land in Bakshi Nagar.
Rushab Aggarwal, who has been recently appointed Standing Counsel by the Union Territory of J&K before the Supreme Court, submitted before the Apex Court Bench comprising Justice Abhay S Oka and Justice Rajesh Bindal that the investigating agency was given no opportunity to investigate the matter and that the High Court had interdicted the investigation almost immediately after registration of the FIR.
Thereafter, the Supreme Court Bench proceeded to issue notice on the petition.
