JAMMU, May 16: In a LPA filed by Senior Aerodrome Officer, presently Airport Director against the order dated 17/04/2023 passed in CM No. 6264 of 2022 in OWP No. 684 of 2011 titled Amrik Singh & Another Versus State & Others by virtue of which Single Judge has condoned the delay despite holding that the grounds taken in the application do not constitute sufficient and reasonable grounds for seeking restoration after the COVID period, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice N Kotiswar Singh and Justice Atul Sreedharan issued notice to the respondents returnable within four weeks.
During the course of hearing Advocate Inderjeet Gupta with Advocate Yatin Mahajan appearing for AAI submitted that petition for condonation of delay filed by respondents is not maintainable because the respondents in their writ petition are claiming rehabilitation for State land measuring 1 Kanal and 16 Marlas and 19 Marlas comprising Khasra No. 27 situated at Gadigarh Jammu.
The Commissioner / Secretary to Government Revenue Department vide his letter dated 18-7-2000 accorded sanction for transfer of State land measuring 276 Kanals and 1.5 Marlas (which includes land claimed by respondents) to Airport Authority of India.
The Government executed Lease Deed on 20th March 2001 for land measuring 276 Kanals and 1.5 Marlas with Airport Authority of India for a period of 40 years to commence from 18-7-2000. Since respondents have no merit in the main case so the Single Judge should not condone the delay.
