JAMMU, June 17: Munsiff Bishnah Assma Choudhary today awarded 2 years rigorous imprisonment and imposed fine of Rs 10,000 on Mohd Shabaz of Sailkot Pakistan under Foreigners Act.
“On 12.06.2023 accused stands convicted for commission of offence under Section 14A of the Foreigners Act, 1946. During the course of arguments on quantum of sentence, APP has made a submission that given the facts of case maximum punishment should be awarded to the accused”, the court said.
“On the contrary, accused in his written submission says that he did not cross the international Indo-Pakistan border out of his own will. He had come for fishing near the border canal when he was attacked by wild bears and he ran towards the Indian army post. On duty army personnel’s fired upon the wild bears and resultantly wild bears fled away. Accused was directed to stop near the gate and army personnel came. They called the accused inside and searched him. They made him sit in a vehicle and took him towards safe room. Accused prays that he is a poor person and a painter by profession”, the court observed.
“Accused is liable to be deported to Pakistan after completion of his imprisonment period. Deputy Commissioner /District Magistrate, Jammu and In charge Superintendent of District Jail Amphalla are thus directed to take necessary steps for deportation of the accused to Pakistan following due procedure of law on completion of his period of imprisonment”, the court ordered.
