HC upholds PSAs of 2 OGWs for subversive activities

Srinagar, July 22: High Court has upheld the detention orders of two Over Ground Works (OGWs) as both the detenues were found to be continuously indulging in anti-national and subversive activities.
Justice M A Chowdhary dismissed the pleas of detenues-Javid Gull and Manzoor Ahmad Hurra who challenged the orders of their detention passed against them by the District Magistrate Budgam on various grounds separately.
Justice Chowdhary after having a glance of the grounds of detention said the detenues are involved in criminal and anti-national activities and did not desist themselves from indulging in such activities. As revealed in the grounds of detention, the court added that their inclination towards secessionist elements gave them a place in the banned organizations of (HM) and (LeT) of which they were active members.
Court after perusal of the grounds of detention said the detenues did not shun the path of their nefarious and anti-national activities and are continuously indulging in anti-national activities.
“The detaining authority after keeping in view the activities of the detenues highly prejudicial and detrimental to the maintenance of the security of the State, detained them under preventive custody, in terms of the impugned orders, which are under challenge in the present petitions”, Court said.
Grounds of detention of both detenues indicate that they working as OGW with Hizb-ul-Mujahideen and Lashkar-e-Toiba outfits had been providing shelter, logistic support to the active these outfits in their area in order to promote terrorism and remained in touch with active members of these outfits.
The record further reveals that the detenues were motivating the youth of the area for anti-national activities by luring them for militant related activities as well as for stone pelting in the area. “The aim of the detenues, as mentioned in the detention order, is to ensure that such objectives are accomplished and for this end they resorted to such activities which have the effect of causing widespread disturbance and instability and also posing threat to the security of the State”, Court said.
