DB directs personal appearance of ex-VC JDA

JAMMU, Dec 21: In a significant development, Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Hasnain Massodi has taken serious note of the non-implementation of the order dated November 10, 2009 passed by the then Division Bench headed by the then Chief Justice Barin Ghosh and Justice Sunil Hali by virtue of which Jammu Development Authority had been directed to demolish the commercial complex at Roop Nagar Housing Colony within two years (by or before November 10, 2011).
Since the JDA failed to ensure compliance of the order, the petitioners O P Bakshi and others filed a contempt petition against the functionaries of the JDA. After hearing Advocate SK Shukla with Advocate Vikas Sharma for the petitioners whereas Advocate Adarsh Sharma appearing for JDA, Division Bench observed, “a perusal of the file along with arguments submitted by Advocate Adarsh Sharma would reveal that there is hardly any compliance of the order”.
“We find that there is prima-facie case for proceeding against Vinod Sharma, the then VC JDA”, the DB said and issued notice for his personal appearance on the next date of hearing. The DB said that former VC JDA and presently Director ERA would be allowed to inspect the record of year 2010 which was shown to the Court by the counsel for JDA.
