CAT rejects claim of retd DIG Prisons for promotion

JAMMU, Aug 23: The Central Administrative Tribunal (CAT), Bench Srinagar has rejected the application of Mohd Sultan Lone, retired DIG Prisons, claiming for promotion as Controller of Prisons (IG Prisons) after retirement.
The Tribunal ordered that the applicant has not been formally put in-charge of the higher post, before his retirement on superannuation, as such his promotion after his retirement is not covered under the relevant rules.
“Further, while considering such cases, the instructions/ opinions of the General Administrative Department and the Department of Law, Justice and PA are strictly adhered to,” the Tribunal stated.
Lone was appointed as Superintendent Jail Grade-II in the Prisons Department of J&K and was promoted as DIG Prisons from 15-10-2009.
The then DG Prisons on 21-12-2021 forwarded a representation of Lone, the then DIG prisons (now retired), requesting for considering his promotion to the post of IG Prisons in terms of relevant rules governing the Gazetted Service of the Prisons Department but Lone retired on 31-12-2021 and after retirement approached CAT which now rejected his claim for promotion to the rank of IG Prisons after retirement.
