15 years RI in rape case

JAMMU, Dec 28: 3rd Additional Sessions Judge Jammu, Sanjeev Gupta today awarded 15 years rigorous imprisonment and fine of Rs 30,000 to kidnapping and rape accused namely Kapoor Singh.
According to the police case, father of a girl filed a complaint before CJM under Section 156(3) CrPC regarding kidnapping and rape of the accused and the same was forwarded to police for registration of a case.
During the course of investigation, girl was recovered and she brought to court for recording her statement under Section 164-A CrPC. It came to fore during the investigation that prosecutrix was treating accused Rajeshwar Singh (since died) as her brother who by taking undue benefit of the relationship, used to take her to his house in order to rape her.
On August 11, 2006 mother of Rajeshwar Singh contacted prosecutrix on phone and asked to visit her house on the pretext that she was but prosecutrix refused to do so. On this, Rajeshwar Singh, in absence of parents of prosecutrix, visited her house and kidnapped her.
The prosecutrix was then taken to Delhi where she was handed over to one Balbir Singh, who took her to Panipat where Kapoor Singh and Kitab Singh raped her for one year. After completion of investigation, police presented challan in the court of law.
After hearing APP GS Charak for the State whereas Advocate Sandeep Gupta for the accused, 3rd Additional Sessions Judge observed, “this is a case of human trafficking committed by the convict for sexually exploitation of minor prosecutrix, which is a very heinous offence”.
Accordingly, Court awarded 15 years RI to Kapoor Singh. The Court also issued General Arrest Warrants against Kitab Singh and Balbir Singh.
