Court grants bail to CE Mech, others

JAMMU, June 22: Special Judge Anticorruption Jammu, Kartar Singh today granted bail to Zahoor Hussain Zargar, Chief Engineer Mechanical, Ranjan Kumar Langer, AEE, Anil Dhar Deputy General Manager M/s CAS India Pvt Ltd and Hanho Yoon alias Calvin Yoon of South Korea, MD M/s CAS India Pvt Ltd Gurgaon.
After hearing Advocate SK Raina assisted by Advocate Rajneesh Raina for the applicants/accused whereas CPO Parshtom Sharma for the Vigilance, Special Judge Anticorruption Jammu observed, “admittedly the allegations of corruption are always serious but offences alleged to have been committed by the accused carry maximum punishment up to seven years imprisonment and as such is not severe”.
“The applicants-accused are in custody for last 10 days and nothing is required to be recovered from them or at their instance and rather the investigation appears to be almost complete. The objections raised by the prosecution that statements of witnesses are not yet recorded, the investigation is at initial stage, is devoid of any legal or factual force”, the Court further observed.
“The investigating agency had sufficient time to get the statements recorded and otherwise, the grant of bail to the accused does not come in the way of getting such statements recorded. In the given circumstances, Court is of the view that further custody of the applicants/accused is not warranted”, Special Judge Anticorruption said.
With these observations, the applications were allowed and accused were admitted to bail on furnishing of bail and personal bonds to the tune of Rs 1 lakh each. Court further imposed various conditions including that the applicant Hanho Yoon alias Calvin Yoon shall not leave the country without prior written permission from the Court and surrender his passport before the Investigating Officer.
Looking into the seriousness of the case, the Court said, “violation of any of the conditions will entitle the prosecution to seek cancellation of bail”.
