Place SSP CID’s case before selection committee for induction in IPS:HC

JAMMU, Jan 6: In a petition filed by Sunil Dutt, presently posted as SSP CID Cell New Delhi seeking induction in IPS, Vacation Judge of High Court Justice BL Bhat today directed the respondents to place the petitioner’s case before the selection committee for his induction in the IPS.
According to petition, Sunil Dutt came to be promoted as Deputy Superintendent of Police with effect from 1st February, 1995 and was further placed as Selection Grade Dy. Superintendent of Police on 17th August, 2000.  He was promoted as Superintendent of Police on 17th August, 2001 and finally placed as Selection Grade Superintendent of Police with effect from 6th October, 2006.
“The Apex Court has set at rest the controversy between direct recruits Sub Inspectors and promotee Sub Inspectors and in compliance to the decision, the direct recruit Sub Inspectors have been granted promotion.  However, the same along with final seniority list was questioned by direct recruit Dy. Superintendents of Police of the year 1999”, the petitioner said, adding “Single Judge quashed the Government Order No.Home-597(P) of 2008 dated 4th September, 2008 and further set aside the order dated  29th April, 2010 whereby final seniority list of Superintendents of Police was issued to the extent of parties to the writ petition”.
The Petitioner assailed the judgment before the Division Bench which stayed the judgment of Single Judge in so far as the same pertains to the petitioner’s seniority as Dy. Superintendent of Police and Superintendent of Police.  It was further submitted that earlier the name of petitioner could not be considered by the Selection Committee for induction into IPS (Indian Police Service) due to pending litigation.  “Now, the selection committee is meeting again on 9th January, 2014 but again the case of petitioner is not being placed before it on the ground that litigation is pending”, the counsel for the petitioner said.
After hearing Advocate Rahul Pant in length, Justice B L Bhat issued notice to Chief Secretary, Commissioner/ Secretary GAD, Commissioner/ Secretary Home, DGP, UPSC and Union Home Secretary returnable within six weeks.
“The case of the petitioner shall be placed before the selection committee, which is meeting on 9th January, 2014, for petitioner’s induction in IPS”, Justice Bhat directed.
