Govt makes amendments in J&K Tourist Trade Rules

JAMMU, Oct 14: The Government today made some amendments in the Jammu and Kashmir Tourist Trade Rules of 1979.
In this regard a notice was issued by Dr. Syed Abid Rasheed Shah, Secretary to the Government Tourism Department.
The order reads, SO:521, In exercise of the powers conferred by section 50 of the Jammu and Kashmir Registration of Tourist Trade Act, 1978, the Government of Jammu and Kashmir hereby publishes the draft amendments in the Jammu and Kashmir Tourist Trade Rules, 1979, as required by sub-section (3) of section 50 of the said Act, for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of fifteen days from the date on which copies of the Official Gazette in which this notification is published, are made available to the public.
“In rule 3 the table of fees shall be substituted by the table appended to this notification; in the second proviso, the word “annual” shall be omitted and the following note shall be added at the end; namely “The Government in the Tourism Department may review and revise the fee structure after such interval of time as it may deem appropriate” the order reads.
In rule 17, the following proviso shall be added; namely: “Provided that the same shall not apply in respect of the applicants having a degree/ diploma or a certificate course (minimum 3 months) in the tourism and travel management/ hospitality sector.
Rule 23 shall be substituted by the following every certificate of registration issued in favour of the dealer, hotel keeper, travel agent excursion agent shall be renewed after a period of three years. However, this shall not take away the powers of the prescribed authority to suspend/cancel the certificate of registration in case of Violation of the Act/Rules, even before the prescribed period of three years.
In rule 24, sub-rule (2) for the words “annual renewal, the words “renewal every 3 years” shall be substituted.
In Annexure, “A” (Part B) under the heading economy class accommodation (C Category) the note appended there to shall be substituted by the note namely, Locality means the site approved/cleared by the authority competent to issue building permission in the area”
In Annexure “A” (Part D) under the heading economy class accommodation (Guest House) the note apprened thereto shall be substituted by the following note namely ‘Locality means the site approved by the concerned competent authority for commercial activities in light of the master plan and also the area where the residential rights of locals are not distrurbed. The building means a built up (ready to use) structure constructed as per the building permission granted by the authority competent to issue building permission in the concerned area”
