* Says 3-tier set up not allowed to flourish

SRINAGAR, Nov 4: Deputy Mayor of Srinagar, Parvaiz Qadri has alleged that the Government has violated the provisions of the Constitution by not announcing the elections well before the completion of the Municipal Corporation’s term.

Addressing a press conference here, along with other corporators on the eve of the term completion, Qadri said that the present administration did not allow the three-tier system to flourish, which has resulted in the suffering of the people.
“As per the 74th constitutional amendment, which was implemented in J&K through the Reorganization Act of 2019, the elections for the ULBs and the Corporation have to be announced before the end of the term. However, here we have witnessed nothing but a sheer violation of the constitution,” he said.
In case of the disbanding of any corporation, Qadri said, while referring to the rules, within 6 months, the elections are to be held.
“We are being told that the Chief Election Commissioner will decide on the elections, but it has to be determined by the Chief Electoral Officer of J&K, in accordance with the rules. If the amendment has been implemented, it should have been followed as well,” he said.
Regarding the conduct of the Assembly elections in J&K, Qadri said that 9 years have passed since the last Assembly election, and the people are suffering, as well as the political class that has been demanding the announcement of the elections.
Coming down heavily on the present SMC Commissioner, Athar Amir, the Deputy Mayor said that they have never been able to meet him while urging the administration not to appoint such officers in the SMC in the future.
