Court convicts man for attempt to murder

Srinagar, Dec 9: Additional Sessions Judge Srinagar today convicted a man for attempt to murder while acquitted three others.
The presiding officer Khursheed Ul Islam convicted the accused Mukhtar Ahmad Shah of Soura Srinagar under section 304 of RPC and kept the matter for quantum of punishment against him on Monday.
Four persons Mukthar Ahmad Shah, Ghulam Mohammad Shah, Arifa Jan and Yasmeena Jan alias Muni All residents of Shah Mohalla Ahmad Nager, Soura, Srinagar were charge-sheeted by the prosecution for murder of a person in 2018.
Court has convicted the accused Shah and acquitted other accused from the charges levelled against them. “Viewed thus, I have no hesitation in observing, at the cost of repetition, that the prosecution has succeeded in proving its case beyond any reasonable shadow of doubt against the accused-Mukhtar Shah for committing culpable homicide not amounting to murder of the deceased. Accordingly he is convicted for offence under section 304 part II, and accused Arifa and accused Yasmeena are acquitted of the charges levelled against them.
The brief facts of the case are that 07.06.2018 the complainant Shakeela came to the Police Station Soura with a written report that on 06.06.2018 her husband Ghulam Ahmed Mir was beaten to death by accused Mukhktar Ahmed Shah along with Ghulam Mohammed Shah, Arifa and Yasmeena during irrigation of land situated at Pandach area with sharp weapon on the back of head.
After interference of locals the victim was taken to Soura SKIMS where he was struggling for life etc and on the basis of this complaint the FIR No.70/2018 was registered U/S. 307 RPC in Police Station, Soura and investigation was taken up. After examining the Preliminary report and FIR it was observed that the occurrence had taken place prior to one day i.e., on 06.06.2018 and the victim was under treatment in Soura Hospital.
After culmination of investigation and on the basis of the evidence recorded during the investigation offence u/s 302,341,201,34 RPC were found to be made out against all the four accused and the charge sheet was presented against them before the court of law.
