Ensure prompt disposal of litigation matters to avoid contempt proceedings: CS to deptts

JAMMU, Dec 25: Taking serious note of strictures being passed by the courts against the departments in different matters, Chief Secretary Atal Dulloo has directed all the departments to ensure prompt disposal of litigation matters to avoid contempt proceedings. Moreover, instructions have been issued for resolving various issues of employees regarding Human Resource Management System (HRSM) portal.
Official sources told EXCELSIOR that while holding detailed deliberations on the litigation matters recently, the Chief Secretary noticed that because of slackness of the concerned officers in different departments the courts are passing strictures against the Government and even contempt proceedings are also initiated which create embarrassment for the administration besides causing delay in the settlement of court cases.
“Taking serious note of this, the Chief Secretary has directed all the departments to ensure prompt disposal of all litigation matters so as to avoid contempt proceedings”, sources said, adding “he has also asked the Administrative Secretaries of Finance and Law Departments to conduct a preliminary exercise on the classification of litigation matters and taking a uniform stand which will serve as an advisory for all departments”.
According to the sources, embarrassment, which the Government is facing in the form of contempt petitions and adverse orders from the High Court as well as Subordinate Courts, is the outcome of the continuous carelessness of the concerned officers in the departments in handling the judgments/directions.
“More so, the senior Government functionaries are made to appear in person before the courts to explain their conduct as well as the reason for non-compliance of directions”, sources said, adding “in most of the cases the orders passed by the courts are not taken seriously and consequently filing of reply/ compliance/status reports get delayed resulting in issuance of adverse orders against the Government”.
The Government has already directed the departments to identify and initiate inquiry against all such officers who are found to be responsible for contempt proceedings by not making right submissions before the courts.
It has also been decided that in case of any adverse orders from the courts on account of non-serious approach of the concerned officers they will be made liable to face disciplinary action including reflection of their conduct in the Annual Performance Reports (APRs).
The Chief Secretary, as per the sources, while deliberating upon the human resource management issues, impressed upon all the departments to ensure timely promotions and filling up of vacant positions so as to do away with the practice of filling up of posts on in-charge basis. “Moreover, various issues of employees regarding HRMS portal be resolved on priority”, sources said quoting the direction of the Chief Secretary.
“There is no end to the process of filling up of posts on in-charge basis in several departments despite the fact that vide Government Order No.1172-JK(GAD) of 2020 dated December 31, 2020 a Group of Officers was constituted for proposing a roadmap/way forward for putting an end to the practice of making adhoc promotions in various Government departments of the Union Territory of Jammu and Kashmir”, sources said and stressed that this practice should be dispensed with as early as possible to ensure streamlined career progression.
Meanwhile, Chief Secretary has directed all the departments to prioritize the referral of vacancies to Jammu and Kashmir Service Selection Board and Public Service Commission in order to facilitate the efficient delivery of public services.
“With respect to manpower audit, all departments shall frame and submit specific proposals vis-à-vis Recruitment Rules, restructuring of manpower etc which shall be worked out accordingly”, read the direction of the Chief Secretary.
