VARANASI, Jan 24 : The Varanasi district court on Wednesday ordered to provide a copy of the report of the scientific survey done by the Archaeological Survey of India (ASI) to the parties involved in the original suit in the Gyanvapi complex case.
In its order the court of District Judge Dr Ajaya Krishna Vishvesha said, “As am of the view that the survey report prepared by ASI has been filed by ASI in the court, both the parties to the suit must be provided copies of the survey report so that they can file objections against the ASI report, if they think it proper.”
It said that without providing a copy of the survey it report to the parties, it will not be possible for them to file objections against it. “Therefore, I am of the view that in the interest of justice, It is necessary that copy of survey report be provided to the parties to the suit,” it said.
The court ordered, “Accordingly, the prayer of the plaintiffs and defendant number 4 Anjuman Intezamia Masajid is allowed. Copy of survey report, prepared by ASI as it has been filed in the court, be provided to the parties in accordance with the provisions as given in General Rule (Civil), the sealed envelope in which, the survey report, presented by ASI, may be opened by the appeal clerk and thereafter, as per the provisions of law and rules applicable, copies may be provided to the parties on their request.”
It may be noted that an application was filed on behalf of the plaintiffs with the prayer that ASI had filed a survey report in the court, therefore, the counsel for plaintiffs requires a copy of the report for contesting the case.
On the other an application was also filed on behalf of the Anjuman Intezamia Masajid with the prayer that the ASI has filed survey report in the court and as the plaintiffs had filed the application with the prayer that the report be transmitted on the e-mail ID of their counsel Vishnu Shankar Jain, if the court comes to the conclusion that report can be sent on e-mail ID the the same may also be sent to the counsel for defendant number 4 on his e-mail ID.
It may be mentioned that earlier on January 6 the district court deferred hearing on the disclosure of the report on Gyanvapi complex while granting the ASI 3 weeks time to submit its report in the original suit in the Court of Civil Judge (Senior Division) Fast Track Court, Varanasi in compliance with the order of the Allahabad High Court.
Meanwhile, the counsel of the Hindu side Madan Mohan Yadav said in compliance with the order of the of district court The District Magistrate (DM), who became the custodian of ‘Somnath Vyasji Ka Tehkhna’ (Vyasji’s cellar) in the Gyanvapi mosque complex on Wednesday took it under custody by completing all the formalities.
