1-yr imprisonment to Prof in sexual harassment case

SRINAGAR,  Jan 24: A local court in Sopore convicted an Agriculture University Professor in a sexual harassment case registered against him by police two years ago.

The Chief Judicial Magistrate Sopore, Adil Mushtaq Ahmad, today awarded one-year imprisonment to Dr Mushtaq Ahmad Dar, Professor and Head Division of Agriculture Extension and Communication, Faculty of Agriculture, Wadura Sopore and also fined him Rs 15,000.

In December 2022, students of the college protested and levelled allegations against the professor and demanded action for his conduct. The VC immediately suspended him for his alleged misconduct and sexual harassment of a female student.

The professor was arrested and an FIR (55/2022) was lodged at Police Station Bomai Sopore in 2022 and later a chargesheet was produced before CJM Sopore.

While giving the judgment, the CJM observed that the role of a teacher is quite similar to that of a mother, of helping a child to learn and grow, intellectually, physically and emotionally.

“It is deeply distressing when a teacher, who is expected to be a guardian and protector of their students, engages in or perpetrates sexual offenses against them. This type of betrayal can have profound and long-lasting effects on the victims, their families, and the wider community. When such disturbing situations arise, it is essential to prioritize the well-being and safety of the students involved. Immediate action to remove the perpetrator from any position of authority or contact with students is warranted,” read the judgement.

“…addressing instances of teachers perpetrating sexual offenses against students requires a multi-faceted approach that prioritizes the well-being of the victims, holds perpetrators accountable, and works to prevent future occurrences,” read the judgement.

The court said that the menace of sexual harassment in work places has become a pernicious, horrid and disgusting practice which often is not reported. Sexual harassment of students by teachers is a serious issue, and it is important for everyone to understand the legal aspects of this matter.

Court suggested the educational institutions to provide awareness programs for students and staff on the provisions of the law and the consequences of sexual harassment.

“Sexual harassment is a serious violation of a person’s rights and dignity, and perpetrators have to remain accountable for their actions. It is essential that the legal system ensures that those who engage in sexual harassment face severe and appropriate consequences,” it said.
