DB directives in PIL regarding facilities for cancer patients

JAMMU, Feb 14: In a contempt petition filed by AV Gupta seeking proper healthcare facilities for cancer patients, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice N Kotiswar Singh and Justice M A Chowdhary has issued certain directions to the concerned authorities.
“This court wish to know from the authorities as to whether the PET Scan machine which is stated to have been installed in SKIMS Soura, Srinagar, is being operated by a candidate who has been appointed on academic arrangement basis or on regular basis”, the DB said and directed that the matter be listed on February 21, 2024 on which date Senior AAG SS Nanda will inform the court about the status of the advertisement issued on February 5, 2024 and also as to whether the Radiation Safety Officer operating the PET Scan Machine installed at SKIMS, Soura, Srinagar, was appointed on regular basis or on academic arrangement.
It was submitted by S S Nanda, Senior Additional Advocate General, that though the PET Scan machine has already been installed at the Government Medical College Jammu, but due to lack of the Operator, the same could not be made functional for which advertisement was issued twice. However none was found eligible in the earlier notification issued on 23.02.2022 because of which delay has occurred in making the machine functional.
It was also submitted that fresh advertisement notice has been issued again on 5th February 2024 inviting the applications of the eligible candidates for the post of Radiation Safety Officer to operate the PET Scan machine installed at Government Medical College Jammu, but on the academic arrangement basis. The last date of submission of applications for the post is 14th February 2024.
During the course of hearing petitioner submitted that it is because of the fact that the advertisement notices are being issued on the basis of academic arrangements, the candidates are not willing to apply for the same.
In this connection, DB said, “we would like to know from the authorities as to whether the PET Scan machine which is stated to have been installed in SKIMS Soura, Srinagar, is being operated by a candidate who has been appointed on academic arrangement basis or on regular basis”.
