Over 15% cases awaiting disposal for 10-30 yrs in JKL HC

JAMMU, Feb 18: There has been a decline of almost 11 percent in the pendency of cases registered with the District & Taluka Courts in Jammu and Kashmir in the past around five months.
However, the pendency has slightly increased in the Jammu & Kashmir and Ladakh High Court (JKL HC), where over 15% of cases are pending for disposal for the last 10 to 30 years.
According to the available data from the National Judicial Data Grid (NJDG), there were 326,264 cases pending for disposal in J&K’s District and Taluka Courts in September 2023, and this number has fallen to 289,325 cases as of February 18, 2024, marking a decline of almost 11% in overall cases in the last five months.
Out of the total 326,264 cases pending for disposal in the lower courts in the UT in September 2023, while 222,823 were of criminal nature, the rest, 103,441 were of civil nature. Against this, while the number of criminal cases as of the current date has fallen to 187,525 out of the total 289,325 cases pending for disposal, the number of civil cases has fallen to 101,800 cases.
As far as the J&K and Ladakh High Court is concerned, out of the total 44,736 cases pending for disposal in September 2023, 36,575 were of civil nature, and the remaining 8,161 cases were of criminal nature. Against this, while the number of civil cases in the J&K and Ladakh HC has decreased to 36,386 out of total 44,759 cases, the number of criminal cases has shot up to 8,373.
If year-wise pendency is taken into consideration, in Jammu and Kashmir’s District & Taluka Courts, 90,090 (31.14%) cases are pending for disposal for the past 0-1 year, 84,545 (29.22%) for the past 1-3 years, 41,084 (14.2%) for the past 3-5 years, 58,426 (20.19%) for the past 5-10 years, 14,743 (5.1%) for the past 10-20 years, 406 (0.14%) for the past 20-30 years, and 31 (0.01%) cases are pending disposal for over 30 years.
Similarly, in the J&K and Ladakh HC, 10,788 (24.1%) cases are pending for disposal for the past 0-1 year, 10,824 (24.18%) for the past 1-3 years, 4,859 (10.86%) for the past 3-5 years, 11,530 (25.76%) for the past 5-10 years, 6,417 (14.34%) for the past 10-20 years, 328 (0.73%) for the past 20-30 years, and 13 (0.03%) cases are pending for isposal for over 30 years.
Nationally, there are a total of 44,158,806 cases pending for disposal in the District & Taluka Courts; of them, 10,898,967 are civil cases and 33,259,839 are criminal cases.
As far as the figures of the High Courts across the country are concerned, there are 4,435,210 civil cases and 1,764,004 criminal cases out of the total 6,199,214 cases pending for disposal at various stages. Out of 80,114 cases pending for disposal at various stages in the Supreme Court, 63,019 are of civil nature and 17,095 are of criminal nature.
