Srinagar, Feb 22: On the assurance of Secretary H&ME for issuing appointment order of aggrieved a petitioner, the High Court dispensed his personal appearance and that of Director SKIMS before the court.
The division bench of Atul Sreedharan and Justice Moksha Kazmi directed to produce the order of appointment of petitioner-Insha Sami Baba as diabetic educator in the SKIMS by next week.
The petitioner-Baba filed the contempt petition seeking implementing the court judgment and the contemnor-Parviaz Ahmad Koul, Director, Sher-e-Kashmir Institute of Medical Sciences, Soura has appeared before the Court and has submitted the details of the electronic transmission of the compliance report to appoint the petitioner as a Diabetic Educator.
“However, the details show that it was sent only on 19.02.2024. There is no satisfactory answer by the Director with regard to the delay in sending the compliance report to the Office of the Chief Secretary”, the bench said.
It is noted that the Supreme Court had dismissed the SLP filed by the Union Territory of J&K against the judgement of High Court last year.
The Administrative Secretary, Health & Medical Education Department has assured the Court that the orders passed earlier directing the appointment of the petitioner as Diabetic Educator shall be executed in the shortest possible time and has prayed for a week’s time to do the needful.
“We accede to the request put forth by the Administrative Secretary, Health & Medical Education Department. List on 28th February 2024 at the top of the list. On which date, the contemnors are expected to produce the appointment order of the petitioner. The personal appearance of both the respondent-Secretary and Director SKIMS are dispensed with”, DB said.
