JAMMU, Feb 23: Justice Sanjay Dhar of Jammu & Kashmir and Ladakh High Court today stayed the FIR registered by Anti-Corruption Bureau (ACB) against Rajinder Sharma, who was PA to the former Minister.
After hearing Senior Advocate Vikram Sharma with Advocate Sachin Dev Sharma for the petitioner, Justice Dhar observed, “it has been submitted that the allegations made in the impugned FIR have been subject matter of departmental enquiry initiated against the petitioner and he has been exonerated in the enquiry”.
“It has been further contended that even the respondent-Anti-corruption Bureau had informed the Director General of Police that the allegations against the petitioner regarding accumulation of disproportionate assets have not been substantiated. In order to support these assertions, the counsel has brought to the notice of this court the relevant documents, which have been made part of the instant petition”, Justice Dhar said.
“Senior Advocate Vikram Sharma has contended that the petitioner cannot be subjected to investigation in respect of same allegations, regarding which he has been exonerated in the departmental enquiry and which have been found un-substantiated in the earlier round of probe conducted by the respondent-Anti-corruption Bureau”, High Court said.
“There appears to be prima facie merit in the submissions made by the senior counsel and as such, a case for grant of interim indulgence is made out. Accordingly, notice is issued to the respondent subject to petitioner’s taking necessary steps within a week’s time”, High Court said and ordered that in the meanwhile, investigation in the impugned FIR shall stay.
