Srinagar, Feb 20: The Jammu and Kashmir High Court today directed the Commissioner/Secretary Department of Health to make personal appearance before the court for not implementing its orders on promotions in Health Department.
A division bench of the Jammu and Kashmir High Court comprising Justice Hasnain Masoodi and Justice Tashi Rabstan today took serious note of the deliberate delay in the implementation of the court orders by the Government.
The court had passed various orders from time to time for finalizing the regular promotion in the Health Department including to the post of Director Health Services, Kashmir.
The court had also directed the Jammu and Kashmir Public Service Commission (JKPSC) to file detailed status report giving exact dates on which the proposal for finalizing the regular promotion in order to enable the court to fix responsibility on erring officials who have erred or delayed the process.
The Counsel for the PSC, Azharul Amin, informed the court that the proposal from the Health Department was received in November 2013 and that was having some deficiencies. “The Health department was asked to complete the proposal so that regular promotions are facilitated. A reminder was also sent to Health Department but they failed to respond”, he informed the court.
The court observed that Health Department is deliberately delaying the matter and implementation of court order dated 01-01-2013.
The Court had directed last year that Government should appoint director Health Services Kashmir in three months strictly in accordance with the Jammu and Kashmir Health and Family Welfare service recruitment rules 2006.
In its August last year Court had directed the Government to make regular promotions for CMOs, MOs and senior consultannts within two months but Government failed to implement the court order.
