JAMMU, Mar 13: Special Judge, Anti Corruption (CBI Cases) Jammu Bala Joyti today awarded 13 years RI and imposed fine of Rs 25000 on Tilak Raj, the then Head Goods Clerk, Railway Station, Jammu in a bribery case.
After hearing both the sides, the Special Judge observed, “it is apt to note that the accused in fact is caught for the first time for such type of offences. He faced the trial for last more than 10 years”, adding “this court hopes that during this long period of more than 10 years, when he has faced consequences of his proved misconduct, he may have, by now a sense of remorse for what he did. More so, he has a family to run, which in fact will consequently suffer if maximum punishment provided in the statute is awarded to him”.
Taking into consideration, gravity of offence and overall facts and circumstances, the court awarded rigorous imprisonment of 3 years along with fine of Rs 5000 under Section 120B RPC and in default of payment of fine he shall further undergo simple imprisonment for 3 months.
Under Section 161 RPC, he has been awarded rigorous imprisonment of 5 years along with fine of Rs 10000 and in default of payment of fine he shall further undergo simple imprisonment for 6 months and Under Section 5(1)(d) r/w 5 (2) of J&K PC Act, he has been awarded rigorous imprisonment of 5 years along with fine of Rs 10000 and in default of payment of fine he shall further undergo simple imprisonment for 6 months.
“All the sentences shall run concurrently and the amount of fine be deposited in the court. Accused be lodged in District Jail Amphalla Jammu to serve the sentence”, the court said.
