Court denies bail to 3 HM activists

JAMMU, June 27: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today denied bail to three activists of Hizbul Mujahdeen namely Sheeraj Ahmed, his wife Faiza Begum and Ghulam Ali.
According to the police case, Sheeraj Ahmed and Ghulam Ali crossed the border in Poonch in the year 2000 and 2004 respectively and went to Pakistan for getting arms training. In Pakistan, Sheeraj entered into wed-lock with Faiza Begum and thereafter trio crossed over to India via Nepal before entering Jammu and Kashmir. However, they were arrested by Chanderkote Police on February 1, 2009.
With their arrest, police foiled plans to cause damage to infrastructure of Baglihar Hydroelectric Project.
While rejecting the bail application of HM activists, Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal observed, “whoever is an enemy agent or conspires to do any act which is designed or likely to give assistance to the military or air operations of the enemy or to impede the military or air operations of Indian forces or to endanger life shall be punishable with death or rigorous imprisonment for life or with rigorous imprisonment for a term which may extend to 10 years”.
“The offences alleged to have been committed falls within the ambit of 3AEO, which imposes death penalty or imprisonment for life. Section 497 CrPC provides that the court shall not grant the bail where the court is satisfied that offence is punishable with death or imprisonment of life”, he said, adding “the embargo laid down in the Section 497 CrPC stands attracted for bail being taken”.
“Investigation is still at infancy stage and there is every likelihood that accused may jump over the bail. There is also possibility of accused attempting to across the border. In case bail is granted there is every apprehension that other militants who are in active in the state as well as the country will get encouraged”, Principal District and Sessions Judge said.
