Court rejects drug peddlers’ bail

SRINAGAR, Mar 6: Additional Sessions Judge, Srinagar, Subash C Gupta today rejected the bail plea of the two accused persons who were arrested by the police with narcotics.
“I am of the considered opinion that petitioners are not entitled to bail at this stage and unhesitant to record here that I have not found any material for recording my satisfaction that their exist no reasonable ground for believing that the petitioner(accused) are not guilty of commission of offence registered against them,” reads the order.
Police had arrested two persons, Fayaz Ahmad Kaloo and Farooq Ahmad Bhat with 5.7 kg of charas at Shalteng Chowk in Srinagar and subsequently booked them under FIR NO.15/2014 for commission of offence U/S 8/20 of NDPS Act.
The Court observed that sufficient evidence has been collected by the investigating officer that they are guilty of commission of offence.
Referring the judgments and arguments of both the parties, the Court said that the petitioners (accused) remained unsuccessful to rigor out from the provisions of Section 37 of NDPS.
“Offences under this Act are serious and grave in nature, and against the society at large. All the state functionaries including judiciary has to arise up to curb this menace with iron hands,” the Court observed.
