7 accused in attempt to murder case acquitted due to prosecution failure

JAMMU, Mar 17: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted Lal Mohd, son of  Sahib Din, Mohd Latief, son of Noor Hussain, Mohd Rashid, Mohd Razaaq sons of Lal Mohd, Resham Bi, wife of Lal Mohd, Diljan, wife of Mohd Rashid and Parveen Akhter, wife of Abdul Majid, all the residents of Sangote, who were facing trial in attempt to murder case for the last 7 years, as prosecution miserably failed to prove the case.
After going through the statements of the witnesses, Principal Sessions Judge observed, “it is very difficult to agree with the prosecution that the accused were present at the scene of offence and participated in the act attributed to them”.
“When there is inconsistency between the statement of direct evidence and even with the medical evidence, there is also doubt about the participation of the accused persons, who without any specification of act said to have caused injuries”, the court said, adding “since the evidence of eye witnesses as to the overt acts is quite unreliable, it is not safe to accept such evidence and convict the accused”.
“Since the testimony of all the eye witnesses has been discredited and the medical evidence is also contradictory to the statement of even the victim the result is that the accused persons are acquitted by giving them the benefit of doubt”, the court and directed that they shall be released.
