Accused in rape case discharged at stage of framing charges

JAMMU, Mar 22: Presiding Officer of Fast Track Court Sanjeev Gupta today discharged one Yash Malhotra, who was allegedly involved in rape case.
According to the police case, a lady aged 30 years lodged a written complaint with Sainik Colony Police to the effect that she started online chat with Yash Malhotra and in the process they exchanged mobile numbers of each other. From the day one, the alleged accused promised her that he would marry her.
On July 7, 2013 at around 1 am, the accused jumped inside the house of complainant and raped her. On this, police registered a case under Section 376 & 458 RPC and statement of prosecutrix was recorded under Section 164-A Cr PC.
After hearing both the sides, Presiding Officer Sanjeev Gupta observed, “father of prosecutrix has stated that nobody informed him about the occurrence though he was present in his house at the time of occurrence”, adding “the charge against the accused is groundless and there is no sufficient ground to proceed against the accused with regard to commission of offences as such prosecution case is dismissed”.
Accordingly, the accused was discharged at the time of framing charge.
