Srinagar, Apr 5: High Court today directed a person, convicted by the trial court for killing a shopkeeper, to surrender before the Registrar Judicial of the Court.
One Rayees Manzoor Bhat was convicted by the trial court U/S 302 RPC in the year 2013 for killing a youth by hitting him in the head with a cricket bat at Nowhatta, Srinagar.
The accused after found guilty for the commission of offence U/S 302 was convicted by the 1st Additional Sessions Judge, Srinagar, and was awarded 10 years rigorous imprisonment with fine of Rs 25000 in 2013.
The accused had moved the High Court and filed an appeal challenging the trial court judgment. During the pendency of the appeal the accused was set free on parole for 21 days on the direction of court. Thereafter the accused had moved an application for interim bail which was allowed and interim bail was granted to the accused for two weeks and the same was extended from time to time till date.
Justice Ali Mohammad Magray after hearing counsel for both the parties dismissed the bail application as well as application for suspension of sentence with the observation that “the convict seems to be more interested in seeking bail and parole rather than to seek disposal of appeal on merits.”
The court made it clear that “this order would not preclude the applicant from making a fresh motion for suspension of sentence or grant of bail, debar the state or its concerned functionaries from considering the convict for grant of parole if such case is pending before them.”
