SRINAGAR, Aug 8: High Court said that despite the mother being a ‘working lady’ does not free and liberate the father of his responsibility to maintain and sustain his children.
Justice Sanjay Dhar said it is a moral duty of the petitioner-father to look after and maintain his children even if their mother is an earning lady. “It is true that the mother of the respondents is a working lady and she has her own income but that does not absolve the petitioner, being the father of the respondents, of his legal and moral responsibility to maintain his children,” HC said.
Court turned down the contention of petitioner-father that the mother of the children is earning hand and he (father) cannot be directed to pay maintenance for the children. The Court dismissed the petition filed by the father against the trial court order whereby he was directed to pay maintenance to his minor children.
