HC restrains Govt from selections

JAMMU, Apr 12: In a petition filed by Anjum Nisar Malik and others challenging the Advertisement Notification No.22-PSC(DR-P) of 2013 whereby 42 posts of Librarians were advertised, High Court has directed the State not to finalize the selection process till next date of hearing.
Advocate S S Ahmed, appearing for the petitioners, submitted that the claims of the petitioners for promotion to the post of Librarian were ignored despite the fact that petitioners being in-service were eligible in all respects as per the Jammu and Kashmir Education (Gazetted) College Service Recruitment Rules, 2008 and Jammu and Kashmir Higher Education (Subordinate) Service Recruitment Rules, 2009 for their promotion.
“The impugned notice is in violation of the rules in terms whereof 60% is meant for direct recruitment and 40% by promotion”, he further submitted.
After hearing Advocate S S Ahmed, Justice Tashi Rabstan observed, “prima-facie a case appears to have been made out”. Accordingly, High Court issued notice to Commissioner/Secretary Higher Education, Director Colleges and Public Service Commission through its Secretary returnable within four weeks.
“Meanwhile subject to objections from the respondents the selection process shall not be finalized and the case of the petitioners, if eligible for the promotion, shall be forwarded”, High Court directed.
