High Court directs for personal appearance of DC Samba

Srinagar, Aug 27: High Court has sought personal appearance of Deputy Commissioner Samba along with the records of detention of a detenue.
Justice Wasim Sadiq Nargal while reiterating its previous order whereby DC Samba was directed to keep the entire detention record of detenue-Narayan Sharma available positively and without any fail said the same has not been done.
The court, keeping in view of non-compliance of its orders directed the District Magistrate, Samba to file an affidavit stating therein the reasons for not filling the counter affidavit and also for not producing the entire detention record as directed.
“This court is constrained to direct the personal presence of the District Magistrate, Samba on the next date of hearing along with the entire detention record of the instant case”, Justice Nargal directed.
The record pertaining to the case was required to be produced by Rajesh Thapa, Additional Advocate General, failing which, it was observed that the writ petition be taken for adjudication on its own merits.
“The court granted last and final opportunity to the respondents to file a counter affidavit which till date has not been filed and even the entire record of the detention has also not been produced”, read the order.
Court also directed for producing the record of detenue pertaining to the Home Department.
