Legal action against NC leader for hate speech

SRINAGAR, Sept 7: Authorities today recommended legal action against a National Conference (NC) leader for allegedly inciting hatred during an election rally addressed by party leader Omar Abdullah in the Ganderbal Assembly segment of Central Kashmir.
Additional District Development Commissioner (ADDC) Ganderbal, Mushtaq Ahmad Simnani who also serves as the Nodal Officer for the enforcement of the Model Code of Conduct (MCC) and its Complaint Management, has called for legal action against Mohammad Ashraf Ganie, a former Sarpanch and NC member.

Ganie is accused of using the term “assassination” in a public speech. The ADDC has also requested an explanation from the Flying Surveillance Team (FST) of Tulmulla for their failure to report the incident in a timely manner.
According to an official communiqué addressed to the, ADDC Ganderbal, the ADDC has recommended the registration of a First Information Report (FIR) against Ganie.
The communique stated that Ganie’s speech, which allegedly targeted individuals disrespecting the party flag, constitutes a breach of the MCC.
“A breach of the Model Code of Conduct has been reported. Mohammad Ashraf Ganie, a member of the NC and former Sarpanch from Peerpora, used the term ‘assassination’ in his speech when addressing the public. His comments were directed at individuals who did not show respect for the party flag,” the communiqué read.
The communiqué further recommended stringent action against Ganie for promoting hatred through his speech and for violating the MCC. It advised that an FIR be filed under applicable laws.
Additionally, the communiqué has been sent to the Flying Surveillance Team (FST) Tulmulla, instructing them to explain their delay in reporting the incident. “Failure to do so will result in stern action as per rules and Election Commission of India (ECI) guidelines,” the communiqué added.
