HC issues show cause notice to media houses for publishing offendable article

Srinagar, Sept 13: High Court has issued show cause notice for contempt proceedings against the newspaper staff of ‘The Hindu’ and new portal ‘ETV Bharat English’ for publishing offending articles.
The Division Bench of Justice Sanjeev Kumar and Justice Rahul Bharti issued notice to these media houses to show cause as to why contempt proceedings be not initiated against them for publishing the offending article in the paper and portal respectively.
Court directed the Registry to send summons to them along with a complete paper book to enable them to file their response to the contempt proceedings by the next date of hearing. The show cause notices have been issued to both media houses after the Registrar Judicial furnished the particulars of owners and other allied staff of these media houses.
The bench on previous date of hearing due to incomplete record of the case and particulars of owner/Editor/Managing Director of these media houses had asked the Registrar Judicial to place on record the newspaper item as well as particulars of owner/Editor/Managing Director of these media houses.
The Court on September 3 had taken serious note of news item published in a national newspaper ‘The Hindu” with regard to working of the court proceedings directed the matter be placed before the Chief Justice for initiating criminal proceedings against the publisher of the newspaper and the CJ directed for initiation of proceedings under contempt of court against both.
The news items under the caption “NIA, Heabus Corpus cases shifted from Justice Atul Sreedharan headed by double bench in J&K, Judge goes on leave” was published in news newspaper ‘The Hindu’.
It was alleged in the news items that the roaster of cases pertaining to NIA and PSAs were shifted midway from the bench headed by Justice Sreedharan to new Division Bench in Srinagar wing of the High Court.
