HC grants pre-arrest bail to Wing Cmdr, restrains police from presenting challan

JAMMU, Sept 14: High Court of Jammu & Kashmir and Ladakh has granted pre-arrest bail to P K Sehrawat, Wing Commander who was booked by the Budgam police for alleged rape with junior.
Justice Rajnesh Oswal also directed that the investigation shall continue, however, the charge sheet shall not be filed. The court further directed that while conducting the investigation, the Investigating Officer shall consider the contention of the petitioner that the investigation by the Police cannot continue, once the Internal Committee has taken the cognizance and concluded the proceedings.
Justice Rajnesh Oswal while granting pre-arrest bail, observed, “prima facie case for indulgence is made out at this stage as the petitioner who is serving as Wing Commander in the Air Force Station, Srinagar and in case of his arrest his reputation as well as the service career shall be jeopardized”.
Accordingly, High Court issued notice which was accepted by Allau Din Ganie, AAG, on behalf of respondents. He has been directed to file status-report by or before the next date of hearing and in the event of arrest of the petitioner he shall be released on bail subject to furnishing of two solvent sureties for an amount of Rs 50,000 each, to the satisfaction of the Investigating Officer and personal bond of like amount.
The petitioner has been directed not to leave the Union Territory of J&K without the permission of his Commanding Officer and shall not contact any of the prosecution witnesses either physically or through any other mode.
