Nomination of 5 MLAs before Govt formation fraud with democracy: Cong

JAMMU, Oct. 4: Congress has vehemently opposed the move of nomination of 5 MLAs before the Govt formation in J&K and termed any such move as an attempt to commit fraud with democracy and mandate of people, as well as the basic spirit of constitution.

Addressing a press conference at PCC headquarters Jammu today, JKPCC working president Raman Bhalla, senior vice president and chief spokesperson Ravinder Sharma , vice president Incharge Hqrs Ved Mahajan along with others said that any such attempt shows desperation of BJP to manipulate numbers, although BJP no way can form the govt by any means.
Sharma said under the Constitutional scheme of things , the Lt Governor has to act on the aid and advice of the Council of Ministers and it would be misuse of the provision of nomination, if it used to convert the majority into minority and vice versa, if any such situation emerges after counting. He asserted that Congress – NC will get comfortable majority to form the govt but this move is anti-democratic and a fraud with democracy and mandate of the people , who have cast their votes to elect 90 MlAs to form govt. by majority. It is the right of elected MLAs, whosoever party or coalition gains majority in elections to form new govt. because people have voted them to power.
“It can’t be the spirit and mandate of the constitution and democracy to authorize a person to convert a majority into minority and vice versa otherwise also. Under the constitution the Governor has to act on the aid and advice of the Council of Ministers, so the Lt. Governor has to nominate 5 MLAs, after the new govt. takes over and recommends the names for the nomination. Any such move would be against the basic concept of democracy & spirit of constitution, if nomination is undertaken prior to Govt. formation,” he added.
JKPCC leaders said the Congress party had favored due representation in Assembly to POJK refugees, KPs and other minorities, before the Delimitation Commission and submitted a memorandum besides raising strong objection to the proposed report, demanding a Sangha Assembly (Sikkim) type reservation of seats to them. The Budhists monastic monks and nuns of 111 minorities have been provided an assembly seats in Sikkim in which only they can contest and cast their votes. Same pattern of elections would have given chance to KPs and POJKs people and other minorities to send real elected representatives from amongst them but BJP betrayed them all,” they regretted.
Sharma said probably BJP had kept this provision of nomination with a view to play this fraud with the mandate of people, to add to the BJP tally.
Congress said that let the new govt take over and then nominate these 5 persons on merit and give them all powers and voting rights etc like it used to be the case with the two women MLAs always nominated in the past by the governor on the aid and advice of the elected govt.
Raising another issue of incident of attempt to attack former Dy CM Tara Chand at his residence in Khour, Congress leaders took serious note of inaction on the part of police. They said no arrest have been made so far despite Election Commission taking cognizance of the complaint. If a former Speaker and Ex-Dy CM is not safe and no action is taken in the matter, what would be the fate of other candidates and common people, they added.
