HC modifies sentence in rape case

JAMMU, Oct 4: High Court of Jammu & Kashmir and Ladakh High Court has modified sentence in a rape case from five years rigorous imprisonment to three years imprisonment. However, fine imposed on the convict was increased from Rs 2000 to Rs 5000.
The judgment has been passed by Justice Sanjay Dhar in an appeal filed by the appellant—Bilal Ahmed Mir, who challenged the impugned judgment of conviction dated 17.07.2023 and order of sentence dated 22.07.2023 passed by 1st Additional Sessions Judge, Baramulla, whereby he has been convicted for offences under Sections 363 and 376 of RPC.
In proof of offence under Section 363 RPC, the appellant has been sentenced to undergo rigorous imprisonment for a period of two years and under Section 376 RPC, he has been sentenced to undergo rigorous imprisonment for a period of five years.
