6 JKPS officers may get DIG-equivalent posts without induction into IPS

Rules being framed on Cadre Formation after 7 years
*Two posts in IGP-rank likely to be reserved

JAMMU, Oct 6: The Union Territory administration is likely to come out with Rules on Cadre Formation for Jammu and Kashmir Police Services (JKPS) which could lead to appointment of JKPS officers on six posts equivalent to the rank of DIGs without their induction into Indian Police Services followed by two posts in the rank of IGPs.

A proposal to this effect was mooted by BJP-PDP Government in 2017 in view of prolonged delays in induction of JKPS officers into IPS and curtailment of 50 percent quota of induction to 33 percent by the Central Government to bring Jammu and Kashmir at par with other States.
Official sources told the Excelsior that though the proposal was formally approved by Mehbooba Mufti-led PDP-BJP Government in 2017, the rules were not framed as the Government collapsed after few months leading to imposition of the Central rule followed by conversion of Jammu and Kashmir into a Union Territory.
“The rules are now being framed and are expected to be issued shortly,’’ they said.
As per the officials, the proposal includes promotion of six senior most JKPS officers against the posts equivalent to the rank of DIGs followed by two on the posts equivalent to the IGPs without the induction of JKPS officers into IPS. Under the existing provisions, only IPS officers can be posted as DIGs and above. A number of JKPS officers in Jammu and Kashmir retired as SSPs as they couldn’t be inducted into IPS due to a variety of reasons.
“The Jammu and Kashmir Administrative Services (JKAS) officers already enjoyed similar provisions as a limited number of them could get the posts reserved for IAS officers without getting inducted into IAS, based on their seniority. However, the JKPS officers were denied similar opportunities,’’ the officials said.
Whenever the proposal matures, the JKPS officers of 1999 batch will be the beneficiaries as those who couldn’t be inducted into IPS due to limited number of vacancies will be able to get posts equivalent to the DIG rank.
From 2011 to 2021, no JKPS officer was inducted into IPS due to legal wrangles and other issues. However, during past about three years, nearly 44 JKPS officers have been inducted into the IPS as the UT Government and concerned departments vigorously pursued the issue of inductions with the Union Ministry of Home Affairs.
But the inductions were not enough and many JKPS officers have been working on the posts of SSPs for a long time and won’t be able to become DIGs unless they are inducted into IPS. But the new provision will make at least six JKPS officers to get the post equivalent in the rank of DIG followed by two as IGPs.
As per the proposal, when the JKPS officers posted as DIG-equivalent posts are inducted into IPS, they will become eligible for regular induction as DIG and the post vacated by them will go to next senior most JKPS officer.
It was in July 2021 that the UPSC had approved induction of 14 serving and 12 retired officers into IPS. Posts of retired officers were later treated as vacant and added into total vacancies. In July 2023, 31 JKPS officers were inducted into IPS
Earlier, the UPA Government headed by Manmohan Singh had created special provision for induction of JKAS and JKPS officers into IAS and IPS with 50:50 i.e. out of total vacancies, J&K got 50 percent direct recruits of IAS and IPS and 50 percent from promotion of JKAS and JKPS officers.
However, with new Government in power in 2014, the ‘Mantra’ of ‘One Nation, One Provision’ was implemented and ratio was restored to 67:33 i.e. 67 percent officers will be direct recruits and 33 from promotion quota as was the case in rest of the States/Union Territories. This significantly reduced promotional prospectus of JKAS and JKPS officers.
