Srinagar, Nov 2 High Court has closed the Public Interest Litigation (PIL) seeking implementation of Mines and Minerals Development Act and Rules, citing that the same is being taken care of by the authorities as such the proceedings are not required to be conducted further in the case.
The PILwas filed complaining that the provisions of the Enforcement of Mines & Minerals (Development & Regulation) At, 1957, Mineral Concession Rules and the Mineral Conservation and Development Rules have not been made applicable in the Union Territory of Jammu & Kashmir, on the ground that the statutory requirement of registered and qualified managers is not being complied with.
It was prayed that a direction be issued to the authorities concerned to appoint sufficient number of Managers/ Assistant Managers and Mining Engineers/ Assistant Mining Engineers having requisite qualification as provided by the Mines Act and also to take all required steps to preserve and maintain deposits and health of the mines and also preserve environment, ecology, landscape and habitation around the mines.
The Division Bench of Chief Justice Tashi Rabstan and Justice Puneet Gupta After having considered the submissions made by the Government counsel and also having gone through the pleadings on the file, said that the issues raised in the PIL are being taken care of by the respondents.
“We are of the firm opinion that the issues raised in the writ petition by the petitioner with regard to implementation of the Mines & Minerals (Development & Regulation) Act, Mineral Concession Rules and the Mineral Conservation and Development Rules are being taken due care by the respondents as such issues raised by the petitioner does not survive any more”, read the order.
The bench therefore concluded that no further proceedings are required to be conducted in the present Public Interest Litigation and accordingly closed the same leaving it free to the petitioner to agitate the issue, if any in future, before the concerned authorities for redressal thereof.
