Court denies bail to Advocate in kidnapping, molestation case

JAMMU, May 12: Principal Sessions Judge Poonch, Jaffer Hussain Beigh today rejected the bail application of Advocate Anzar Ahmed, who was arrested by the police in kidnapping and molestation case.
According to the police case, on March 23, 2014 Advocate Anzar Ahmed forcibly took the prosecutrix towards forest areas. The prosecutrix was molested before being rescued by the people.
Accordingly, FIR under Section 366 and 354 RPC was registered against the accused and after completion of the investigation challan was presented in the court of law.
After hearing battery of lawyers for the petitioner whereas Public Prosecutor Choudhary Nazir Hussain, Principal Sessions Judge Poonch observed, “Public Prosecutor has resisted the application on the ground that the accused has committed heinous offences despite being law knowing person as such he is not entitled for concession of bail”.
“It has also been stated that the accused is an influential person in the society and there is every apprehension that he will jump over the bail and tamper with the prosecution witnesses”, the court further observed, adding “petitioner is not an illiterate person that he did not know the pros and cons of the shameful act”.
“Instead of giving protection to woman, he has committed condemnation act with her. The public confidence in the judicial system shall get shaked if any lenient view is taken”, the court further said, adding “it has been stated by the Public Prosecutor that Bar at Mendhar went on strike to favour the petitioner and all this does not suggest that fair trial is possible if the petitioner is admitted to bail”.
With these observations, Court rejected the bail application.
