JAMMU, May 20: Principal Sessions Judge Jammu, RS Jain today acquitted alleged HM militant Tanvir Ahmed, son of Nazam Din of Doda, who was facing trial under 3 Enemy Agents Ordinance, 7/25 Arms Act, 6 Wireless and Telegraph Act, due to legal infirmities and reasonable doubts in the prosecution case.
“The prosecution has failed to examine the IO thus deprived the defence the chance of putting its case as well as the contradictions and omissions to him for his explanation”, the court observed after hearing both the sides, adding “the non-examination of the IO has certainly caused a prejudice to the accused in his defence”.
“The prosecution case is full of legal infirmities and reasonable doubts as such the accused is entitled to the benefit of doubt”, the court. Accordingly, accused Tanvir Ahmed was acquitted of the charges framed against him.
