HC directive to DM on migrants’ property

JAMMU, May 23: High Court today directed the District Magistrate Anantnag to take all steps for preservation and protection of the migrants’ property in the district.
The direction was passed in a petition filed by Shamboo Nath Tickoo and others mentioning that some unknown persons have illegally and unauthorizedly taken possession of their immovable property situated in district Anantnag.
After hearing the counsel for the petitioners, Justice Janak Raj Kotwal observed, “the law on the subject provides for taking over of possession of immovable property of a migrant by the concerned District Magistrate”, adding “the law further provides that the District Magistrate shall take all such steps as may be necessary for preservation and protection of such property”.
“Moreover, the Act provides for eviction of unauthorized occupants of such property as such the petitioners are within their statutory right to claim protection of their immovable property and seek eviction of unauthorized occupants by the competent authority”, Justice Kotwal said.
With these observations, High Court disposed of the petition with the direction to the District Magistrate Anantnag to discharge duty vis-a-vis the immovable property of the petitioners and ensure compliance of the provisions of the Act.  “The proceedings in this regard be commenced and concluded expeditiously preferably within eight weeks”, High Court directed.
