HC modifies stay order, issues fresh direction

JAMMU, May 29: In a petition filed by Dr Kulbir Singh and others challenging the selection/appointment  of 769 Medical Officers in the Health and Medical Education Department vide Notification No 1-PSC (DR-S) dated February 25, 2014, High Court today modified the stay order with the directions to the respondents not to fill up the vacant posts.
After hearing Advocate Ankesh Chandel appearing for the petitioners whereas Deputy AG Neeru Goswami for the Health Department, Senior Advocate DC Raina with Advocate FA Natnoo for the PSC and Senior Advocate PN Raina with Advocate JA Hamal appearing for the private respondents, Justice Tashi Rabstan observed, “according to the Deputy AG Neeru Goswami the selectees/appointees had joined in their respective Directorate of Health Services prior to the issuance of interim directions”.
“In view of this and the submission made by the counsel for the respondents, interim order dated March 12, 2014 is modified to the extent that the selection/appointment of private respondents pursuant to the Govt Order 132-HME of 2014 dated March 4, 2014 shall be subject to outcome of the petition”, he said. Justice Rabstan, however, directed respondents not to fill up the unfilled vacancy.
