HC directs Govt to charge sheet docs receiving freebies

Srinagar, June 2: Jammu and Kashmir High Court today sought status report regarding the initiation of prosecution against the five doctors who have been accused of receiving cash, freebies and gifts from pharma companies for prescribing their medicine to patients.
A Division Bench of the Court comprising Chief Justice MM Kumar and Justice MH Attar directed the Government to file the status report within two weeks along with charge sheet against these doctors.
The direction was passed after the Law Officer Health and Medical Education Department Altaf Ahmad, who was present in the court, revealed the department is contemplating framing of charge sheet against these erring doctors.
“Mr (J A) Kawoosa (Additional Advocate General) after receiving instructions from Law Officer H&ME Department that the department is contemplating framing of charge sheet against each and every one, he requested and is granted two weeks time to do the needful,” the court directed.
The department earlier in terms of court directions had started inquiry against Dr. Fayaz Ahamd Peerzada, incharge Chief Medical Officer, Budgam; Dr. Javeed Ahmad Zargar, Medical Officer Sub District Hospital, Chadoora; Dr Abdul Ahad Wani, Consultant Medicine, Sub District Hospital, Baramulla; Dr. Firdous Ahmad Vaid, Medical Officer, Sub District Hospital Yaripor and Dr. Javed Ahmad Wani.
An affidavit filed by Dr. Des Raj Bhagat in Public Interest Litigation stated that in respect of every one of them a prima facie case has been found.
The instant Public Interest was filed against the receiving gifts, freebies by the doctors for prescribing particular medicine of their favourite Pharma Companies.
