AIIMS Board to examine IG CRPF

SRINAGAR, June 14: Jammu and Kashmir High Court directed the authorities to constitute the Medical Board of All India Institute of Medical Sciences(AIIMS) for medical examination of Inspector General of Police CRPF, S S Sandhu, to find out whether the officer falls under the SHAPE-I category in accordance with guidelines or not.
“The Medical Board may be constituted expeditiously and intimation may be sent to the appellant for appearing before it and the reconvened Medical Board of AIIMS be placed before this court on or before adjourned date”, the Division Bench comprising Chief Justice MM Kumar and Justice MH Attar after ordered here.
The direction was passed by the court after Sandhu’s advocate RA Jan after obtaining the instructions from the appellant that he is willing to present himself before the Medical Board.
Court also said that the Board shall act in accordance with the observations made in order dated:-5.12.2012 where in it has been observed that whether Sandhu has disabilities of SHAPE-2 or as SHAPE-3.
Court while hearing the Letters Patent Appeal filed by Sandhu challenging the order of writ court wherein his writ petition was dismissed and his demotion order passed was found correct and genuine as he was not fulfilling the eligibilities for the post. However, the Division Bench while granting interim relief to Sandhu had directed the authorities to main status quo.
“A pristine question raised by appellant is whether he falls under SHAPE-I in accordance with guidelines or falls in a category lower than SHAPE-I. In the event he is found in SHAPE-I then he would be promoted as IG retrospectively from the date of such promotion given to him with all consequential benefits,” the bench observed.
Sindhu was promoted as IG CRPF by Home Ministry in September, 2012, but his promotion order was later withdrawn in April, 2013.
