HC directs DC to release Rs 1 lakh to victim’s family

SRINAGAR, June 18: High Court today directed the Deputy Commissioner Srinagar, Farooq Ahmad Shah to release an amount of Rs one lakh to a woman Raja as interim ex-gratia relief for death of her husband allegedly in BSF custody.
Court while granting the interim relief to the petitioner observed that she cannot be left high and dry without any support from the Government and to wait till conclusion of investigation.
The wife of deceased Ghulam Nabi Bhat alleged that her husband was arrested by BSF in 2002 and allegedly killed in custody.
Director General BSF and Commandant BSF admitted this fact in their reply, but have stated that the deceased while making an attempt to escape from custody fell into a 50 feet deep nallah and sustained multiple injuries and breathed his last in SKIMS on July, 2002.
State Human Rights Commission in 2007 had also directed the State Government to provide ex-gratia relief of Rs 1 lakh to the wife of deceased and also compassionate relief of any Class IV appointment for her survival.
Commission had also directed for registration of FIR which was subsequently lodged in 2008 in Police Station Lal Bazar.
Court also directed the SHO Lal Bazar to file latest status of investigation by or before August 6, the next date of hearing.
