HC for SIT to check docs’ freebies

SRINAGAR, July 3: Jammu and Kashmir High Court today directed for constitution of task force to carry out surprise checks of doctors receiving freebies, gifts, and kickbacks for prescribing particular medicine of their favourite pharmaceutical companies.
A Division Bench comprising Chief Justice MM Kumar and Justice Hasnain Masoodi whole closing a PIL on doctors receiving freebies, gifts, and kickbacks for prescribing particular medicine of their favourite pharmaceutical companies directed: “The respondents shall constitute a task force for surprise checks and to find out if any other doctor has been indulging in similar type of practice with any company offering such kickbacks, and if any pharma company is found indulging in such type of activity then appropriate case be registered besides blacklisting such company.”
The court observed that the goal in the instant PIL has been achieved and the prayer made by the petitioners has been accepted as is evident from the status report filed by respondents.
The Bench directed the Government to take the charge sheet filed against five doctors-Dr. Fayaz Ahmad Peerzada, incharge Chief Medical Officer, Budgam, Dr. Javeed Ahmad Zargar, Medical Officer Sub district Hospital, Chadoora, Dr Abdul Ahad Wani, Consultant Medicine, Sub district Hospital, Baramulla, Dr. Firdous Ahmad Vaid, Medical Officer, Sub district Hospital Yaripor and Dr. Javed Ahmad Wani – to its logical end and conclude expeditiously within a maximum period of 6 months.
The court also directed these doctors be asked to furnish the details of their movable and immovable assets so as to ascertain it at appropriate time, if their assets exceed their own sources.
Earlier, Additional Advocate General Javed Kawoosa pointed out before the court that a circular in this regard has been issued in January last year by the Medical Council of India to regulate the professional conduct of registered medical practioneers with Indian Medical Council Regulations 2002, wherein accepting of any gift, travel facility, hospitality or monetary grants has been prohibited.
“Directions should be carried out and status report in this regard be filed within two weeks before the Registrar Judicial of this court,” the court directed.
