JAMMU, July 16: 2nd Additional Sessions Judge Jammu, Subash C Gupta today rejected the bail application of Sultan Mehmood Mirza, then SHO Police Station Gandhi Nagar, who is in custody since September 27 for his alleged involvement in the fudging of  weapon in Amandeep murder case.
After hearing Special PP Senior Advocate Sunil Sethi for the State, 2nd Additional Sessions Judge observed, “it can safely be held that  there are strong accusation against the accused-petitioner which proves prima facie his involvement in grave, heinous and serious offences of  hatching criminal conspiracy with the other accused for swapping /fudging of weapon of offence and bullet fired, in a murder case”.
“Severity and degree of punishment is at higher side. Faith of the general public would be shattered in case, accused-petitioner is admitted to bail, in such a heinous crime”, the Court said, adding “though, the individual liberty is considered as a cardinal right of an accused, yet it can be scarified, where the large interest of the society is involved”.
“The Courts are supposed to deal with accused with iron hands in order to re-impose the confidence of the public at large in the administration of  criminal justice”, 2nd Additional Sessions Judge said.
With these observations, Court rejected the bail application of Sultan Mehmood Mirza.
