JAMMU, Oct 4: Principal Sessions Judge Kathua, Vinod Chatterji Koul today awarded six years rigorous imprisonment and fine of Rs 3000 to Som Nath and Subash Chander, sons of Badhawa Ram of Chhan Rorian, who were facing trial in attempt to murder case for the last five years.
After hearing both the sides, Principal Sessions Judge Kathua observed, “keeping in view all the facts and circumstances and while balancing the aggravating and the mitigating circumstances, the ends of justice will be met in case both the accused are sentenced to undergo rigorous imprisonment for a term of six years and also to pay fine of Rs. 3000 each for commission of offence punishable under Section 307 RPC”.
“In case of default in paying the fine, accused shall undergo further imprisonment of three months each. They are further sentenced to undergo imprisonment for a period of three years and fine of Rs 1000 each for offence punishable under Section 452 RPC. In case of default in paying the fine, accused shall undergo further imprisonment of one month each”, the court said.
The court, however, clarified that both the sentences shall run concurrently.
