Life imprisonment to OGW of HM

JAMMU, Dec 31: Principal Sessions Judge Bhaderwah, Sanjeev Gupta today awarded life-imprisonment and fine of Rs 10,000 to Over Ground Worker of Hizbul Mujahideen outfit namely Mushtaq Ahmed, son of Hasam-ud-Din of Gandoh.
After hearing Advocate NK Gupta for the accused person, Principal Sessions Judge observed, “it is established that convict has committed the murder of an innocent lady by a fire arm and also caused grievous injury to her daughter”.
“However, after taking into consideration aggravating and mitigating circumstances besides long incarceration of more than eleven years of the convict this case does not fall in the category of rarest of the rare”, the court said and awarded rigorous imprisonment for life and a fine of Rs 50,000 to the OGW under Section 302 RPC.
In default, the convict shall undergo simple imprisonment for one year. The convict was further sentenced to undergo rigorous imprisonment for seven years and a fine of Rs 5000 under Section 307 RPC. In default, the convict shall undergo simple imprisonment for a period of two months. He was further sentenced to undergo rigorous imprisonment for three years  and a fine of Rs 3000 under Section 452 RPC.  In default, the convict shall undergo simple imprisonment for two months. He was also sentenced to undergo rigorous imprisonment for three years under Section 27 Arms Act.
